Terms of Use
8Interactive Limited (“8Interactive”) provides “The Service” which consists of 8Interactive.com and a number of related mobile applications, including but not limited to “Feed Me Tech”, “FeedMe Guardian” and “Read Me Stories”.

By using the Service, you are agreeing to be bound by the following terms and conditions (“Terms of Use”), which includes our Privacy Policy. Your use of the Service constitutes your acceptance of these Terms and Conditions. By agreeing to these Terms of Use, you also agree to the terms and conditions of any license agreement(s) that effect or are affected by the Service.

8Interactive.com (the “Service”) is subject to the following Terms and Conditions:

  1. You are responsible for any activity that occurs under your screen name or identity.
  2. You must not abuse, harass, threaten, or intimidate other users of the Service.
  3. You must not impersonate another person.
  4. You must not use the Service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
  5. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, and links, that you submit, post, and display on the Service.
  6. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with 8Interactive.com.
  7. You must not create or submit unwanted email or messages to any other person or entity using the Service (“Spam”).
  8. You must not transmit any worms or viruses or any code of a destructive nature.
  9. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Violation of any of these agreements will result in the termination of your ability to use the Service.

You use the Service at your own risk.

Payment for Book Services

The Service includes the Book Service, which is the ability to receive electronic books via the Read Me Stories mobile application (“App”), and the ability to purchase those books in hard copy from Amazon.com. Use of the Book Service is subject to the following Term and Conditions:

  1. You get a new book to read every day that you use the application. Of course, you can always re-read the books that are already in your library, including your favorites.
  2. New books do not ‘accumulate’ during the days you do not use the application. This is designed to encourage your child to experience and practice reading new books everyday – this is best for learning and retention.
  3. The application comes with a free trial. Once that trial period is up, you will need a library pass to keep giving your child the gift of reading books and getting a new book every day.
  4. All of our books are available for purchase in print form via the ‘Order Book’ feature of the application. This is a great way to reward your child with his/her favorite books. The cost of print books is not included in the price of the library pass.
  5. Your library pass goes into effect today (assuming you complete the transaction today). Your payment today pays for your next month’s use of our book service which lets you keep reading books, and brings you one new book every day you use the application.
  6. We will automatically bill you on a recurring basis each month thereafter, on the day closest to your subscription anniversary day (today).
  7. You may cancel your library pass at any time. Just use the ‘Feedback’ button in the application, which sends us an email. In the subject line write ‘unsubscribe’. In the message body we would love to hear why you’ve decided to cancel. By email we will confirm your desire to leave our program, and that’s it. Simple and easy. We also include a ‘Cancel’ button in the monthly email that contains your invoice. When you cancel, we will not bill you again. You will still be able to use our service and get new books until the remainder of your library pass runs out. When your library runs out (reaches it’s expiration date),  you won’t get any new books. You’ll be able to continue reading the demo books that come with the app itself, but reading of other books will not be possible.
  8. When you pay with PayPal, you have all the consumer protections that PayPal provides you. And if you pay with a credit card directly, you have all the protections that your credit card company provides you.
  9. We’ve included the ‘Feedback’ button in the application so that you can tell us what you think anytime, good or bad. We want to hear from you.
  10. We will never share/sell your email address or other information about you to any outside party, and you can opt out of communication with us at any time – we are here to serve you, not spam you.

Book Service Refund Policy

The Book Service is subject to the following additional Terms and Conditions:

  1. Our policy is to do everything under our power to keep you as a happy customer. But if we’ve screwed up, we’ll immediately grant you a refund.
  2. If you feel that you should be granted a refund, just press the ‘Feedback’ button in the application, which sends us an email. In the subject line write ‘refund’. In the message body please tell us what we did wrong, the amount of the refund that you are requesting, and your rationale. By email we will happily discuss the problem with you, and grant whatever refund is fair under the circumstances. Simple and easy.
  3. Some things are not under our control. For example, you may have a problem with your ISP (underlying your WiFi broadband connection) or your mobile carrier (underlying your mobile broadband connection) that prevents your device from contacting our internet service(s). We don’t think you should ask us for a refund in these kinds of scenarios.

Privacy Policy

  1. We will never share/sell your email address or other personal details to any third party without first obtaining your permission, except where we are required to by law.
  2. We may use your email address to contact you in regards to our Service. However, you can opt out of communication with us at any time – we are here to serve you, not spam you

Security Policy

8Interactive is committed to providing a high level of security for your payment transactions. All payment transactions are secured using Secure Socket Layer (SSL) encryption to prevent packet sniffing and data interception.

General Conditions

  1. We reserve the right to modify or terminate the Service for any reason, without notice at any time.

  2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail using the email address you provided when you subscribed to The Service. What constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.

  3. We reserve the right to refuse service to anyone for any reason at any time.

Trademarks

  1. 8Interactive, FeedMe Tech, FeedMe Guardian, ReadMe Stories and all other trademarks, service marks, graphics and logos used in connection with the Service are trademarks or registered trademarks of 8Interactive Limited or its licensors.
  2. Other trademarks, service marks, graphics and logos used in connection with the Service may be the trademarks of third parties.
  3. Your use of the Service grants you no right or license to reproduce or otherwise use any 8Interactive or third-party trademark

Limitation of Warranties

Except as otherwise expressly stated herein, all Content posted to or available from the Service is provided “as is”, and 8Interactive and its owners, suppliers and licensors make no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title or non-infringement of proprietary rights. You understand and agree that you download from, or otherwise obtain Content and services through, the Service at your own discretion and at your own risk, and that 8Interactive and its owners, suppliers and licensors will have no liability or responsibility whatsoever for any damage (whether to your computer system, data or otherwise) that results from the download or use of such Content or services.

Disclaimer of Warranty

The Service is provided on an “as is” basis without any warranties of any kind. 8Interactive does not warrant that the Service will operate error-free nor that the Service is free of computer viruses or other harmful mechanisms. 8Interactive makes no warranties about the accuracy, reliability, completeness, or timeliness of the Service Content, software, text, graphics, and links. 8Interactive, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose and non-infringement.

Limitation of Liability

In no event will 8Interactive or any of its owners, suppliers or licensors be liable to you or any other party for any direct, indirect, special, consequential or exemplary damages, regardless of the basis or nature of the claim, resulting from any use of the Service, or the contents thereof or of any hyperlinked website, including without limitation any lost profits, business interruption, loss of data or otherwise, even if 8Interactive, its suppliers and its licensors were expressly advised of the possibility of such damages.
